Definition of cookies

Cookies are data created by a server and stored as text files on the hard disk of your computer and they allow the functioning of this website, the use of a specific function explicitly requested by the user, which means they allow to improve the functioning of this website, such as those cookies which make browsing faster or show the content of greatest interest for the user according to the previous choices. Cookies can be permanent (so-called persistent cookies), but can also have a limited duration (so-called session cookies). This website uses both persistent and session cookies. Session cookies are not stored permanently on your computer and disappear when the browser is closed. Persistent cookies are used to personalise your experience based on the tool used by the user (computers, tablets, smartphones) as well as third-party cookies that are used to analyse site accesses (for example Google Analytics) and to allow users to share contents from the website on social networking sites or email. These cookies can be stored permanently on your computer and a variable duration.

Types of cookies

Italian Legislation (Article 122 of Legislative Decree 196/03 “Personal Data protection Code” hereinafter “Code”) has introduced into our legal system the Community Directive 2009/136/CE which requires website managers to use cookies or other tracking technologies to inform the user about the types of cookies used by the website. The Provision of the Personal Data Controller n 229 dated 8 May 2014, published on the Official Gazette n. 126 dated 3 June 2014, categorised cookies in two macro categories known as “technical” cookies and “profiling” cookies.

  1. Technical Cookies, normally installed by the owner or manager of the website, have to purpose of “carrying out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the contracting party or user to provide such service” (see Article 122, paragraph 1, of Privacy Code). The prior consent of the users is not required for the installation of Technical Cookies. Technical cookies are further divided in:

    • Session Cookies, which guarantee normal browsing and use of the website allowing, for instance, to make a purchase or to authenticate to access restricted areas. These cookies are not stored permanently on the device used by the user and are automatically deactivated when the browser is closed. Their use is linked to the transmission of personal data necessary to allow safe and efficient navigation on the web pages. Session cookies do not allow, in any way, the acquisition of the user’s personal data.

    • Analytics Cookies, used to collect information about the use of the website anonymously and to obtain both statistical analysis of the pages viewed and the behaviour of the user. This anonymous analysis provides information and suggestions to improve the quality of the website and to make the content the user seeks the most or is more interested in easily accessible. Analytics cookies can be sent both from the website and third-party domains and in no way allow the acquisition of the user’s personal data. Analytics cookies, if installed by third parties (e.g. Google analytics), even if they collect data anonymously, are related to profiling cookies, as indicated by the Personal Data Controller.

    • Functional Cookies: These are related to technical cookies if used directly by the manager of the website to collect information, in aggregate form, about the number of users and how they use the website. These cookies allow the user to browse the website according to a series of selected criteria (e.g. the language) in order to improve the service provided to themselves.

  2. Profiling Cookies, have the purpose to create user profiles and are used to send advertising messages according to the preferences shown by the user while browsing online. These cookies are particularly invasive in the user’s private sphere, and for this reason the European and Italian legislation requires the user to be adequately informed about their use so as to be able to express their consent. Article 122 of the Privacy Code refers to them stating that “the filing of information in the terminal device of a contractor or user or the access to information already archived are permitted only on condition that the contractor or user has given their consent after have been informed with the simplified procedures referred to in Article 13 of the Privacy Code, paragraph 3” (Article 122, paragraph 1 of the Code).

In the same Provision the Personal Data Controller has further categorised cookies according to the subject operating as data controller of personal data, making a distinction between first-party cookies and third-party cookies.

  1. First-party Cookies
These cookies are managed by the owner of the website. The obligation to provide information about these cookies lies with the owner of the website. Moreover, it is up to the latter to indicate how to possibly block these cookies.

  2. Third-party CookiesThese cookies are managed by a third party different from the owner of the website. The obligation to provide information and indication of the methods on how to possibly block these cookies lies with the third party, while the owner of the website is obliged to add the link to the site of the third party, in which such elements are available, on the website. In both types of cookies (first-party or third-party) the collection of consent, necessary if the cookie is a profiling one, takes place via a special banner on the homepage of the website.
